Mogelpackung für Inter*: Offener Geschlechtseintrag keine Option

500px-HSSection_sign.svgAuf der Website des Deutschen Bundestags wird verkündet: “Bei Kindern, die ohne eindeutige Geschlechtszugehörigkeit zur Welt kommen, ist es künftig möglich, im Register auf eine Geschlechtsangabe zu verzichten.”
Diese Aussage legt nahe, dass der Bundestag die Wahlmöglichkeit für Eltern intergeschlechtlicher Kinder geschaffen habe, die Geschlechtsregistrierung offen zu lassen. Tatsächlich lautet jedoch der Beschluss:

”(3) Kann das Kind weder dem weiblichen noch dem männlichen Geschlecht zugeordnet werden, so ist der Personenstandsfall ohne eine solche Angabe in das Geburtenregister einzutragen.“

  • Das bedeutet im Klartext, dass es sich nicht um eine Wahlmöglichkeit, sondern um eine Vorschrift handelt.
  • Wer legt fest, dass ein Kind “weder dem weiblichen noch dem männlichen Geschlecht zugeordnet werden” kann? Nach bisheriger Praxis: Ausschließlich die Medizin. Deren Definitionsmacht darüber, was Geschlecht ist und wer welchem Geschlecht zugewiesen wird, bleibt mit der Neuregelung unangetastet.
  • Gleichzeitig ist es extrem unwahrscheinlich, dass Ärzt_innen sich zu einem solchen Attest entscheiden, sofern nicht die Eltern stark darauf dringen. Die Gefahr der Stigmatisierung wäre in der Tat sehr groß. Daher könnte im Gegenteil, die neue Vorschrift (potentielle) Eltern und Ärzt_innen zusätzlich darin bestärken, ein “uneindeutiges” Kind um jeden Preis zu vermeiden (durch Abtreibung, pränatale “Behandlung” oder sogenannte vereindeutigende chirurgische und/oder hormonelle Eingriffe). Sofern das Motiv der Neureglung gewesen ist, chirurgisch-hormonelle “Vereindeutigungen” von Kindern zu verringern, so ist abzusehen, dass dieses Ziel nicht erreicht werden wird.
  • Statt die Geschlechtseintragung für alle, nicht nur intergeschlechtliche, Kinder einfach offen zu lassen, werden erneut Sondervorschriften geschaffen, die Ausschlüsse produzieren. Die Lebenssituation der allermeisten intergeschlechtlichen Menschen wird sich dadurch nicht verbessern.

Was wir brauchen, ist ein Ende der fremdbestimmten Geschlechtszuweisung, der Praxis geschlechtlicher Normierung und Verstümmelung sowie der medizinischen Definitionshoheit über Geschlecht.
